Islamic Will

Many people have neglected writing their wills. Though death is the final destination of every living thing regardless of age, health or consciousness. The will is something that benefits and affects the status of the dead person after life according to the Hadith:

“If the son of Adam is deceased, all of his actions stop except for three things: ongoing charity, valuable knowledge, or a righteous offspring who prays for him/her.”

 

It has been narrated by ibn Umar (may Allah be pleased with him), that the Messenger of Allah, may Allah’s peace and blessings be upon him said:

“It is not allowed for any Muslim who has something that can be bequeathed to stay two nights without a written will with testimonies.”

Will Guidelines

1- A testator is not allowed to write his/her will using more than one-third of his/her wealth.

2- Hastening in writing the will is recommended. According to the Hadith narrated by ibn Umar (may Allah be pleased with him), that the messenger of Allah, may Allah’s peace and blessings be upon him, said,

“It is not allowed for any Muslim who has something that can be bequeathed to stay two nights without a written will with testimonies.”

3- The testator has the right to cancel, renew, or modify his/her will whenever he/she deems it necessary, even if it is authorized by the court. Because it is a non-binding contract, its execution is conditioned by the testator’s death.

4- Writing the will does not mean to stop spending money in charity in your life.

5- All the debts and credits of the testator should be written clearly in the will. This is so that the executor can have a clear status when he deals with his/her responsibilities.

6- If the testator had paid for their marriage some of their children, it is not allowed to specify a certain amount of money to the other non-married children.

7- The inheritors must be aware of this will.
