Custody (hadanah) in Islam is meant to ensure the well-being of children who cannot live independently. Scholars unanimously agree that the mother is more entitled to custody of young children, as her care and compassion are most needed at that stage. However, this right normally ends if she remarries, since she may be distracted by her new husband.

The Prophet ﷺ said to a woman disputing custody with her ex-husband:

“You have more right to him so long as you do not remarry.” Abu Dawud 2276

At the same time, scholars stress that custody is about the child’s best interests, not parental privilege. Ibn Qudamah explained:

“Custody is aimed at looking after the child, so it should not be given in a way that will be detrimental to his welfare and his religious commitment.” (Al-Mughni, 8/190)

Since maintenance (nafaqah) is the father’s responsibility by Qur’anic command Al-Talaq 65:7, refusing to provide it shows neglect. Ibn al-Qayyim and Ibn Taymiyyah both stated that any parent who neglects the duties of custody forfeits guardianship.
